Battleships without Hyperspace level 4?

In the score section, the person with Hyperspace engine is level 3. Level 4 is needed for a battleship. Yet someone in the score section has 4 battleships. How is this possible?

The scoreboard's bugged, so for every new colony you get you have to uncheck the box again. The probably moved their BS to the new colony.
